Terms & Conditions

My Nexus Card ("Service", "we", "us", "our") is operated as a sole proprietorship by George Tabora ("Operator"), based at 6550 Rock Spring Dr., Bethesda, MD 20817, United States. By creating an account, accessing, or using the Service you ("User", "you") agree to these Terms.

1. Beta status

The Service is currently in BETA. Features, pricing, and availability may change at any time without notice. You acknowledge that bugs, downtime, data inconsistencies, and breaking changes are expected. Do not rely on the Service for irreplaceable data; export your contacts regularly.

2. Eligibility & account

  • You must be 18+ and capable of entering binding contracts.
  • You are responsible for the confidentiality of your password and all activity under your account.
  • You agree to provide accurate information and to update it when it changes.
  • One person per account; sharing credentials is not allowed.

3. Subscription, billing & refunds

Paid plans (Starter, Pro, Team) are custom-scoped by written agreement with the Operator following a discovery call. Once scope is agreed, the Operator sends invoices directly for the applicable setup fee and recurring monthly (or annual) charges. Free plan users are not billed.

  • Setup fees are non-refundable once paid, as they fund onboarding, data migration, and AI personalization.
  • Subscription fees are refundable in full within 7 days of the first invoice if requested in writing to georgeatabora@gmail.com. After 7 days, fees are non-refundable for the remainder of the billing period.
  • You may cancel any time by written notice; cancellation stops future invoices. The Service remains active until the end of the period you paid for.
  • Non-payment or late payment beyond 15 days of invoice due date may result in suspension or downgrade to the Free plan.
  • Prices are subject to change with 30 days' notice; existing prepaid periods are honored at the rate paid.

4. Free plan

The Free plan is available at no cost and includes limited features (see the pricing page). No credit card is required to sign up. Feature limits may change with reasonable notice.

5. Acceptable use

You will not:

  • Use the Service to send spam, unsolicited marketing, or any communications that violate CAN-SPAM, TCPA, GDPR, CASL, or similar laws.
  • Upload contacts whose information you did not obtain lawfully or who have asked not to be contacted.
  • Reverse engineer, scrape, or attempt to circumvent rate limits or security controls.
  • Use the Service to infringe intellectual property, harass, defame, or violate any third party's rights.
  • Use the Service to process information of minors under 16.

You are solely responsible for the legality of every email and SMS you send through the Service. The Operator may suspend accounts that generate excessive bounce, spam complaint, or carrier-filter rates.

6. Third-party services

The Service relies on the following third parties. Your use of the Service is also subject to their terms:

  • Stripe, Inc. — payment processing (used only if the Operator issues invoices via Stripe; may not apply during BETA)
  • Resend, Inc. — email delivery
  • Twilio Inc. — SMS delivery
  • Google LLC — Google OAuth sign-in (optional)
  • Google LLC (Gemini API) — AI-powered card scanning & template drafting
  • MongoDB, Inc. & cloud hosting provider — data storage & compute

7. AI-generated content disclaimer

AI features (business-card OCR, message drafts) are powered by third-party large language models and may produce inaccurate, incomplete, or fabricated output. You must review AI output before sending it to a real human, saving it as contact data, or relying on it for any decision. The Operator is not liable for outcomes arising from un-reviewed AI output.

8. Your content & data ownership

You retain all rights to the contacts, notes, templates, and other content ("Your Content") you upload. You grant the Operator a worldwide, royalty-free license to host, process, transmit, and display Your Content solely to provide the Service. We will not sell, rent, or share Your Content with third parties except as described in the Privacy Policy.

9. Service availability

We aim for high availability but do not guarantee uninterrupted access. Scheduled maintenance, third-party outages (Stripe, Twilio, Resend, Google, MongoDB), and force-majeure events may cause interruption. The Service is provided "AS IS" without warranties of any kind, express or implied.

10. Limitation of liability

To the maximum extent permitted by law, the Operator's total aggregate liability for any claim related to the Service shall not exceed the amount you paid in the 12 months preceding the event giving rise to the claim, or USD $100, whichever is greater. We are not liable for indirect, incidental, consequential, special, or punitive damages, including lost profits, lost contacts, or lost business opportunities.

11. Indemnification

You agree to indemnify and hold harmless the Operator from any claim, damage, or expense (including reasonable attorneys' fees) arising from (a) Your Content, (b) your use or misuse of the Service, (c) your violation of these Terms, or (d) your violation of any law or third-party right.

12. Termination

You may terminate at any time by canceling your subscription and deleting your account. We may suspend or terminate your access immediately for breach of these Terms, fraud, abuse, or non-payment. On termination, your data will be retained for 30 days for recovery, then permanently deleted (except where retention is required by law or for payment records).

13. Governing law & disputes

These Terms are governed by the laws of the State of Maryland, USA, without regard to conflict-of-law principles. Any dispute shall be brought exclusively in the state or federal courts located in Montgomery County, Maryland, and you consent to personal jurisdiction there. The losing party in any dispute pays the prevailing party's reasonable attorneys' fees.

14. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced via in-app notice or email at least 14 days before taking effect. Continued use after the effective date constitutes acceptance.
